I was on a flight from FLL to JFK last week and while we were sitting on the tarmac for 2 hours, a passenger in First Class was called off the plane for some reason, and didn't return. An older gentleman from the back was then upgraded to the new empty First Class seat. I was under the impression that he was the next one on the upgrade list. Guess it's a YMMV.
