Is what LH says is True?
Dear Dr. B,
We thank you for your mail sent to our General manager, Mr. Deepak
Biswas who has requested us to reply on his behalf.
Dr. B, we refer to our mail dated 07th September, where we have
clarified the stand taken by the colleagues at Mumbai airport only after
seeking a clarification from the German Consulate representative. Mr.
Biswas has been in the loop and is aware of the case. The Visakodex
regulations quoted by the representative of the consulate indicates the
process and terms of issuing a Schengen visa, which clearly states that
the visa has to be granted by the Member State whose territory
constitutes the main destination. If that cannot be determined the
Member State whose external border the applicant intends to cross at the
start of the journey has to be contacted for issuance of the visa.
Your parents ticketed itinerary was from Mumbai to Budapest via Munich
and return from Prague to Mumbai via Munich. The German Consulate has
checked with the Swiss Consulate who have mentioned that the tickets
shown to them at the time of obtaining the visa were issued by Swiss
Airlines. The German Consulate has also informed that in case the
itinerary had changed it was the responsibility of the passenger or
his/her appointed travel agent to inform this to the Swiss Consulate and
to check if the same visa could be used to travel to Hungary first and
not Switzerland. The facts presented to the Swiss Consulate, which had
led to the issue of the visa, were no longer relevant and this could
have led to the annulment of the visa.
Dr. B, we once again confirm that our flight LH - 765 on 20th
August 2012 from Mumbai to Munich was not overbooked and passengers were
denied boarded due to documentation. We have reviewed your case in
details and conclude no new information warrants a change in our
decision.
