Question about Best Price Guarentee

I was waiting exactly 10 day to review my claim by Accor Hotels and today received most strange answer I ever heard / refusing my claim of course/:

On the basis of the information you have provided, and after investigating the matter, it appears that the Best price guarantee is not applicable as the offer you found isn’t available or bookable anymore on the other Website.


In our general terms for the application of the Best price guarantee we inform that the room category claimed for must be available and bookable on another website at the time of verification by the Accor customer service department.

of course there is no information in T&C that rate must be bookable on time of verification by Accor Hotels.

Please guys can you confirm they are right? Lower rate must be bookable on time of verification? in my case it was in 10 days time
