Yes and maybe, maybe not depending on how heavy your use is.
For casual use, it's a non-issue (assuming someone is technically apt enough to do it, and the carrier can't detect the tethering or doesn't overcharge for tethering vs. a separate tablet plan).
For heavy use, I'd wonder whether battery life on the phone or additional load on the phone in other senses might turn out to be a problem.
