That is not true at all. Delta knows who violates the COC and can send the customer a bill for the difference if it wants to. Violating the terms of a business contract in exchange for paying a penalty has nothing to do with ethics.
It would be unethical if the customer hacked into Delta's computer system and hid the fact that he even had a ticket for ATL-BHM. But as it stands, Delta will know when he violates the COC and will have a remedy.
It's not the customers fault if Delta
chooses not to exercise its rights.
