The fact that we have figured this out (some sooner than others) and that it is now confirmed tells you that they won't get away with it.
Plus, in many cases it's very obvious that you are missing upgrades to TODs. I have been on flights that were on PMCO 767s with 27 seats left to sell just before checkin (I use KVSTool to check availability) and I've missed those upgrades in some cases being 10+ down the list at the gate. Pretty obvious what happened...
