Capital One advised me that I CANNOT get the annual fee waived under any circumstances:

2. NOT transfering to a NO FEE card
Every bank I have dealt with in the past was willing to cancel annual fee IF you closed the account but Capital One refuses to cooperate.
If you are within 30 days of the fee being posted, you should get it credited back if you close the account.
Use the online chat if the phone csr is not so cooperative
