I wonder where should we draw the line between the rights of smokers and the rights of non-smokers. I wished more people were thinking the way you do (bold).
I think, however, that those of us old enough to remember having been forced to be in restaurants that had "smoking areas" (like a swimming pool having a "pissing area," if you ask me) are simply happy not to have to put up with being around concentrated smoke in such settings and are somewhat more tolerant because we remember how bad it used to be. I am betting that kids just turning 20 are going to be a lot less tolerant.
Not to be overly graphic, but urine is non-toxic and sterile but does have an odor, just like cigarette smoke. How would anyone feel if people were urinating in public, splashing the stuff around on others, and then being offended when the splashee complained about the assault, using as their justification that urine is non-toxic, sterile, and just has an odor that others might not like? Is it the right of the public pisser to do as he pleases? Sorry, but that is the way a lot of people feel about being subjected to cigarette or cigar smoke. And by the way, smoke is actually toxic, unlike urine.
I'm not trying to be overly dramatic, as I know how hard it is for people to give up smoking - I have very poor luck with many patients who often have to try multiple times to finally kick the habit. I know how hard it is for them, which is another reason I try to tolerate it when I can, especially as most smokers in the US (or at least California) these days really do try hard to avoid annoying others.
