I shiver to pit myself against the extensive knowledge of yourself and Shareholder but I believe the non-smoking ban can only be enforced on Canadian registered aircraft. If a foreign registered bird that supports onboard smoking lands in Canada it is immediately subjected to Canadian anti-smoking laws but the aircraft is under the law/regulations of the carrier's country until the no smoking sign goes on at the top of descent into a Canadian city.

I've tried to find the exact wording in the CARS but their site is a real challenge to navigate. What I quoted in my earlier post is the wording right our of our manuals.

If I'm wrong, please educate me.
