From what we were told in the past, TODs were not offered unless there were more seats available than there were elites on the list. Obviously in the case of that ORD-LGA flight, with 47 on the list, and $89 upgrades being offered, that didn't apply?

I think all it means is that once you upgrade, you can't undo it. It does say directly next to it that if the event that the flight is cancelled and you are not re-accommodated in F, then you're refunded the upgrade fee. Seems pretty fair to me
