If he was prepaid and checked-in online then Hertz is breaching contract because once you put your time on the check-in that is your car if you use it or not. The clock for the rental starts the time you put on check-in
If he just prepaid and did not check in then it is based on availablity. If they do not have a car then he gets his money back.
