That's not actually true - the majority of contract law in the UK for example is set by precedent much the same as in the US and when things are put into statutory law it's almost always reactionary so in terms of people getting screwed over very similar.
Anyway contracts don't have to be fair, they just have to be legal. If you sign an agreement to return it with x amount of fuel I really can't see any court paying the slightest amount of attention. Your best bet if you don't like the system is to go elsewhere really... or complain to high hell, companies don't like bad press
