Nope, I do not have any legally confirmed info, and I would imagine that should they start such a process, there will be a way to argue that you could not take the flight due to sickness and then develop it further... But I would be curious to learn more about the legal aspect (need a new topic for my PhD thesis)...

Not really between end of check-in and end of the boarding, but in general. LH, as we all know, loves to oversell flights, so by not checking in, OP may save headache for gate agents who would be otherwise trying to find volunteer for VDB, etc... This one extra seat may be so much needed for someone...
