They are not. TSA occasionally apologizes and claims they've changed their ways when they get truly caught, such as in the Bierfeldt case you mentioned where the passenger recorded the TOS abuse. But then they just keep doing the same thing.
The Kathy Parker incident in PHL was post Bierfeldt. (questioned about diet pills, wallet searched, referred to law enforcement for carrying "almost sequential" checks made out to her and her husband, threatened with arrest and charges if she did not explain the checks)
There have been other publicized incidents too which I can't recall at the moment.
