Couple of points. Do you know for certain that the pilot was "deadheading?" Deadheading means he was on the clock and pilots are entitled to some priority for upgrades to F seats if they are on the clock.

Do you know for certain that he was non-revving or is it possible that he bought a ticket? Do you know for certain that he was not the #1 on the upgrade list? It's also possible that he was commuting as a non-rev on his way to work or home.

For all we know, the pilot was the next on the list and entitled to that seat. What we do know is that the OP contains numerous assumptions without any confirmation as to whether any of them are justified.
