with the same logic you could make a third pilot mandatory that takes the seat when the pilot goes to the toilet.
If those people in the Emergency exit row are on the Toilet while the emergency starts that's very unfortunate but at least then there is no kid sitting in the way of someone who might be able to help.
The other question is: why would you want to swap with your kid? It surely can't make use of the extra legroom.
