If you didn't ask if there would be a fee, you really can't fault them for not telling you there would be one because of the bad credit card number.

Um no, I don't have to tell my waiter not to add a $100 charge to my bill after I pay and leave the restaurant for it to be illegal for him to do so. Its the responsibility of the merchant to get consent for a charge not the customer.
