When you buy a coffee they give you a price. They don't add on a "coffee shop tax" to cover cost of boiling the water and providing the tables.

When you buy gasoline they don't charge a "filling station tax" to cover the cost of the pumps.

It may or may not be not be outside the letter of the law, but it is well outside the spirit of the law.
