Legality of Taxes levied by AF on Awards (US-Dom)

SFO-LAX-ATL on December 5th:
DL4770 followed by DL2075

Computed taxes for purchased ticket using ITA: $36.47


As per the US AirFrance website, I have the following:
12500 Miles
Award Surcharge: $0
Taxes: $70.20
Total: $70.20

Besides the usual debate about using miles to purchase Economy seat, is it legal in the US to claim $70.20 in taxes which in fact amount only to $36.47?

Have the DOT or DOJ investigated these actions in the past?
