OP asked if there was an EU rule for cdn flights.
There is no EU 3 hour rule AFAIK - the EU rule I'm guessing your talking about Is regarding compensation for delays. Secondly, if you go back to read the OP, they specifically mention the US 3 hour rule. Where do you get EU from that?
