While the award change may prove to be poor business decisions, I don't see how it could become a legal problem.
There's a rumor that sometimes lawyers disagree among themselves. In fact, they usually present alternatives for management, with an assessment of litigation risks and costs for each alternative. They ask, How much do you want to bleed?
Of course, companies think through policy decisions. Later, they don't change their minds, but they may make a new decision based on new information. FT'ers and others will oblige Delta with some new information.
