And if the airline forces you to check a carry-on over some nit-picking crap like wheels or handles (which has not yet happened to me personally but I have observed it too often with others on European LCC's which are big on the stinking sizers), then they ought to be absolutely liable for ANY damage while it is in the hands of their incompetent baggage mishandlers / luggage losers.
If the carry-on bag is oversized, it should be checked, and depending on how much oversized it is the airline should give consideration to storing it under some pipe leaking a mysterious blue liquid. We all know when we are trying to get away with oversized bags, if one doesn't want to check a bag then they should make sure the bag conforms, and pack properly.
