No, I don't think any OP can be off topic in his/her first post of the thread. Think of it this way, any first post sets the topic, therefore it can't be off topic.

Talking about moderators may be against the FT terms of use, but it is not necessarily off topic if, as in this case, the topic is moderators.

Posting about terms of service in a thread which is about moderators is, however, off topic.
