As in so many TSA related issues, it all comes down to the contents of the SSI Memo which defines "resistance." Every one striper has seen it, 313 million other Americans and every foreign visitor are not allowed to see it for National Security reasons.

The shortest way to answer the OPs questions seems, to me, to make an end run and force the public disclosure of the SSI Resistance memo.

It may take a fare with time, money, some civil disobedience, and a good lawyer to accomplish.

What happens, hypothetically, if a fare shows up at a checkpoint with a "Kiss My Resistance" t-shirt and says the same to the screener? The goal would be to goad a thin skinned screener to declare that a "vulgar statement" and call a LEO and ask for an arrest. At some point the TSA would have to state why this is a vulgar statement by offering a definition. If they do not, how can any rational court convict someone for a law that cannot be defined or mentioned to the public?

"Your Honor, he said the undefined new anatomical term "resistance" in public!!!! Jail him!!!!"
