The irony here is that the decision you made to ensure the bags made it is likely what caused the miss. Most likely the CO folks saw some bags that were just going to EWR and figured they'd make the next flight down no big deal, not knowing that they'd miss the last flights to FRA where you really wanted them to be.

CO should be on the hook to ensure delivery to you all the way to your door.
