Is anything being done about waistband searches?

I just came across this 6month old article, and was wondering if anybody knows how it's doing

"If it is skin to skin, if someone were to take their hand and put it underneath somebody's blouse and touch someone inappropriately and go skin to skin, that's a felony, and if it's done simply over the clothing, according to California law, that's a misdemeanor," Wagstaffe said.
I'm reading day after day in here about people who opt-out getting the waistband treatment. I've read very explicit descriptions every single day as to what is being touched on both males and females on these searches. Under the DA's quote above, he would be pursuing them for a felony. So my question is, has it happened? (which I know it hasn't) If not, why not? It seems he has the guts to.
