I see a few people around me who suffer from parental kidnapping. They are literally helpless because the court order or joint custody does not work outside US. They even reach a random Korean like me beg some help (whose kid and ex-wife are in Korea). There was even a movie (TV movie, though) about this subject. This is very serious problem in US. I believe there are similar problem reversely.

I think an airline should not allow using foreign passport without i-90 or any entry proof if the kid is born in US and going abroad for the first time. Well, if the kid was born in US, thus has US passport, the kid cannot (illegal in US, in fact) use foreign passport when in/out US. Then JAL should stop this in the beginning? I don't know. Something should be changed..
