He wants to enter the US. So the EU/DE transfer rules are not of any interest in this case.

@OP: If the airline agent(s) overlook the expiry date, the immigration guys in the US won't. I wouldn't try to enter the US with a passport that doesn't comply with the rules you pointed to (PDF file).
