Airline faces suit after man found dead in washroom

My thought on this matter... Canadians are becoming more litigious these days.
How can one blame heart attack on airline not doing its job to maintain safety? The family should sue the tobaco and fast food companies instead.
Quote: The family says that Mr. Charnalia "died, sitting alone in an aircraft washroom, without any attention paid by the flight staff to the passenger's well-being and safety."
What does this family expect? A plane cabin is not an ICU? Who keeps track on how long you stay in a washroom? It is not unusual to stay there for 45 minutes for constipation, after waiting 20 minutes for you turn... So why would airlines be concerned if one stays in the washroom for more than an hour? There is no record anyway so why argue that he was there for 3 hours?
Even if he is discovered within minutes (let's say 10 minutes), his chance of surviving a resuscitation is less than 5%. It is the patient's responsibility to ensure that he is fit to fly. There is no requirement to pass a medical before ticket purchase, so airlines should never be held responsible for an individual's illness.
I feel bad for that doctor trying to resuscitate him... he is probably part of the suit now, either as a defendant or witness.
