I'm going to use my niece as an example, because I don't have a daughter. But I have traveled with my niece under my sole protection and have thought about how I would try to deal with such a situation if it occurred.

1. I think after I set those preconditions (videotape and LEO witness) and I put TSA on notice with the statute, and the 'reserving her rights' verbiage, that IF they still decided they needed to pat her down, you can be pretty sure they're not going to go within 6 inches of her genitals or breasts.

2. I would remind my niece (in front of the TSA and the LEO) that it is ALWAYS appropriate to scream and protect yourself if a stranger tries to touch your breasts or your genitals, and that she will have my full support and the support of the police officer standing next to me if that happens.

3. If they committed any act that amounted to sexual assault or sexual battery under the law, I would have sufficient evidence to sue them and/or bring a test case to have this problem settled for good.

If we really needed or wanted to fly, and my niece totally understood and agreed to everything, these would be risks I would be willing to take. If she said no, we would leave the airport. Period.

I think teaching young girls to set boundaries and protect themselves as much as they can in an intolerable situation is about the best we can hope for until Congress or the courts wake up.
