I don't really think it is a TOD issue. It looks like they ran an EUA sweep at the time when you found "R" space and called to get your Mileage Upgrade Processed (Remember EUA happens dynamically during T-24. So when you saw the R space, and someone checked in for the flight when R is open, that would trigger EUA to run). And the ELR seats could be "non elite" since they can buy from anytime in advance. Or they could be silver at the bottom of the list. It doesn't really seem to fishy to me as there are only a few people on the upgrade list currently.
