Even still, if a bag is not weighed on a scale I don't see how they can make weight an issue. Maybe its an American thing but I don't think any airline has the right to enforce a weight limit without weighing the bag on a scale. Burden is on the airline to prove a bag is overweight.
I overheard an FR gate dragon arguing with a pax at LGW last week that "your bag feels overweight, take some things out or you can't fly, or if you want to dispute the weight we can go out to the customer service desk and weigh it there, but you'll have been offloaded by the time you get back".
(I did see the guy on the flight; I believe he managed to repack his and his partner's bags to the satisfaction of the gate dragon.)
