It doesn't ; if the system says that the minimum driver age is 23, then that is the case and even making the booking would not avoid the issues; that the Hertz system isn't set up to filter out bookings where the person making the booking does not meet the requirements is just a problem of the site ; it doesn't provide a loophole
You may have to accept that until he turns 23, he will not be able to drive a vehicle from Hertz; either you may need to drive or perhaps see if any other car rental companies have a lower age limit in Spain
