Good question. This is my own view on it, remember I wasn't invited to the party that created the criteria. Gummy Bears, or similar, in their regular form, before you pull them half melted out of your pocket, are for the most part, relatively solid. In other words, you can't readily spread them, like you can pudding or peanut butter, or things like that. Again, my own personal view. May not be the real reason but I'll go with that.
