I have a hard time believing someone would be so bold as to say "You caught my eye, they didn't." I am not saying that it isn't possible, but I look at it through my eyes. I like having a clean record at work and I think a statement like that would be too high risk for serious complaint.
This is in California, a two-party state. He can't legally be recorded without his knowledge so it's reasonably safe--his word against hers.
