Its a shame that most people think that 'If its on TV, it must be true' People, an officer dosent need a warrant to arrest, if an officer takes your property for evidence, and returns it to you, it was never confiscated. And the basic rule of courts is, No Harm, No Foul. Study your law codes before you decide to argue with an officer and put yourself in more trouble.
At what point does it become a confiscation? One minute? One hour? Overnight? One week? One month? One year? A harm has occurred when property is removed from your possession under color of authority with no legal right to do so.
