If the flight is oversold, will even further shenanigans occur, wherein pax without seats will be placed in F in front of Elites?
If it was me I would pay the $39. If it is an equipment swap and you get downgraded you'll get the downgraded compensation. If not you'll have secured an F seat. Should you have to pay, no. But with today's upgrade climate I would.
