We reject Gilmore's right to travel argument because the Constitution does not guarantee the right to travel by any particular form of transportation.
Actually it guarantees the right to travel via any form of transportation. If airplanes had been around when the document had been written they would have included them. Just because the constitution does not specifically mention a particular activity does not mean that it is not protected. Air travel is a form of travel and our right to travel is guaranteed by the constitution. I cannot imagine how the founding fathers would react to statements like the one above. They might pull out their muskets and start shooting.
