I don't think so. As deranged and power-hungry as TSA is, they seem committed to letting passengers opt out of the nude-o-scope. I suspect it's because their lawyers claim that the option helps make the entire procedure defendable as constitutional/legal. Their strategy seems to be making the opt-out as miserable and painful as possible.

And besides, if they prohibit voluntary opt-outs, all we have to do is go to a drugstore and buy a sling. Can't put your arm above your head? No nude-o-scope. Same thing with a wheelchair. Or a shoulder injury.
