5 pm is daylight, he's walking on a path, and he steps on a 2.5 ft long snake? Either he really wasn't watching where he put his feet, or he was playing tough guy and trying to show off for his wife and kicking the snake. He does come from Rhode Island, which doesn't have venomous snakes, but still, catch a clue, buddy.
My sympathy is with the snake.
That's a lot of assumptions. Who says he wasn't looking elsewhere than his feet while strolling the grounds. When I walk I seldom stare at the ground as it causes me to walk into things like poles and buildings, especially in NYC. Besides wildlife has a unique ability to blend in with the scenery and he could easily have mistaken a motionless snake for a branch or piece of wood.
