I am not necessarily against the idea and maybe I could have explained myself differently.

DOT probably could institute such a rule, but it has not instituted a rule refunding fares if passengers do not arrive on time, so I doubt it would institute a rule refunding bag fees if the bags do not arrive on time. Maybe DOT stays away from refunds.
