On 2nd July the 'Airport Express' train that I was on from Berlin Friedrichstraße station to Berlin Schönefeld Airport broke down resulting in me missing a flight but Deutsche Bahn are refusing to pay me any compensation and I need help.

The train broke between stations, after waiting on the train in truly stifling heat for approximately 1hr 15mins we were pulled by a 'tug' train to the next station (Berlin Karlshorst) and left there, after approximately half an hour a new train arrived to take us on to the airport.

Due to the approximately 105 minute total delay from the train breaking down to finally arriving at the airport I missed the deadline for checking in (I was originally due to arrive at the airport 2 hours and 3 minutes in advance of the flight) and therefore missed my flight

I have sent all the details to DB, after one month they asked me for my bank details so I assumed they were going to pay me. I chased them 6 weeks later and received a letter in German & although I do not speak German via Google translator I believe it states that "we regret any inconvenience caused and ask at the same time that no compensation can be made in your case because we must apply the statutory rules on passenger rights to all customers equally"

Although the DB Airport Express train broke down and caused me to miss my flight, they are not paying me anything. There were no more flights to my destination that evening so I booked myself into the Holiday Inn at the airport and am claiming for the hotel and food - E100) and the flight I purchased that left the next day that cost me E117.

I understood that the new EU Regulation (EC) No 1371/2007 on rail passengers' rights would cover me in a situation like this. Does anyone knows if it does? I do have full travel insurance which I can claim on as a last resort but I am determined that DB fulfils any obligation that it may have. Should DB pay me compensation?
