can't see anything in the CoC about this. It looks to me that, in they refused to carry you in such a situation, it would be an IDB and they would be liable to :
a) pay you compensation under Reg 261/2004
and
b) reroute you at no extra charge (so you could still claim a refund of the second ticket if it is refundable) OR (at your choice) get a full refund of the first ticket (in addition to the compensation) and you could then use the second ticket to travel.
