I wonder if anybody would do a test case risking little money on special fares within Europe just for the purpose of suing the airline and make a doctrine out of it.

I certainly wouldn't want to serve as a guinea pig on this - and would discourage the OP from volunteering!

Court cases are uncertain, expensive, and generally not worth 'choosing' to get if you ever can avoid it without being aggrieved. As mentioned by others, every single airline enforces the rules of having to use (1) all coupons and (2) in order and to be honest, I don't find this rule unfair. As mentioned by Xandrios, the rule allows the airline to offer discounted prices for people with connections, return flights, and fixed dates while charging point-to-point corporate customers a premium which, in my view, fairly reflects their added flexibility and comfort (nonstop flight) of travel.
