Without going into the legal mumbo jumbo I am pretty sure that pax have been arrested for threatening the safety of the airport and other pax. The justification once was (as seen on TV) a passenger making a joke about having a machine gun in his violin case was considered a direct threat to the airport officials. It may not hold up in court, but I believe the guy was arrested.
