Oh -- I see the objection now...
Scenario 2: Before the listing closes, a new bidder places a bid of 30 miles for one of the items. The remaining nine items are won by the first nine bidders who bid at 10 miles. However, because all bids clear at the lowest winning bid, the person who bid 30 miles will only be required to pay 10 miles for the item. By bidding over the opening price, new bidders can essentially knock the earlier low bidders out of the running.
This language could be interpreted such that it conflicts with itself, though. "Earlier" could be interpreted to be "first." I do not believe that was the intention, though.
