I am not a lawyer, but based on a few contract law classes I took, this is very questionable. For any rental car customer, it's an unreasonable expectation to be knowledgeable and skillful to fill the tank on the exact mark at a random place, on a car that the customer is not familiar with the gas mileage. The term would have been nullified in any court of contract law.
