Kind of curious, what TSA policy has been over turned in court? Maybe in tired, but can't think of any... Oh, there are some stupid TSOs out there (by TSOs I mean including up to STSOs and Managers) who do some stupid things, or think stupid things, but right now at 1 AM I'm at a loss to think of policy that has been over-turned.

But the point of my previous post is this: it is very possible congress has exempt TSA from any kind of previously mentioned regulation to deploy these machines. If you really don't remember, congress was in a panic over the Dec 25th incident, and TOLD TSA to deploy many more if the machines.

If I was a sneaky, crafty TSA lawyer, knowing what TSA biologist and physists have said about the effects of backscatter, I would inform congress we couldn't deploy more units because of regulation. And if a crafty TSA lawyer did so, what are the odds congress acted upon it?

Again, this is allllll speculation. But if I ran TSA it's how I would have done it (actually I would have just deployed the MMW machines, not backscatter, but you know what I mean!).
