The FAA is a tombstone agency; they generally only react when something gets broken or someone is hurt. Can you cite an incident where this scenario made for an unsafe flight? Let’s not give the Feds ideas for new and exciting FARs.

As an aside, time permitting in the course of a planned emergency, the FAs will place able bodied PAX in the exit seats as part of the cabin prep procedure.
