If the offer was made to accept the dog in the cargo hold, then certainly not. Even if the option was not offered, I find it unlikely as the OP wasn't denied boarding, Fido was. I've never read the CoCs that accompany my cat's PNR but I bet there's a waiver of those sorts of claims. (Furthermore, I suspect the fine print will negate any legal recourse for the OP)

The other question for the forum: is the pet embargo an AA/AE generated thing or is there something else to it? It seems to me that, assuming the OP is being forthright about their history and situation, AA/AE might want to make an exception just to solve the problem.
Apparently (and I base this on a quick search I did simply b/c I found it odd that there were so many pets on the flight) AA puts the embargo in place for flights ex-Grenada at the end of the academic term b/c there are so many students traveling w/pets to the states for the summer.
